GENERAL TERMS AND CONDITIONS (GTC)
for the provision of the software service (SaaS) CarpCup

Article I.
Basic Provisions and Identification Data

These General Terms and Conditions (hereinafter referred to as the "GTC") bindingly, exclusively, and exhaustively govern the rights and obligations, as well as the commercial, technical, and liability conditions between the software provider and the operator of the CarpCup platform, which is the company:

MIBO-SPRINGS s. r. o.
Registered office: Jablonica 340, 906 32 Jablonica, Slovak Republic
Company Identification Number (IČO): 57573361
Tax Identification Number (DIČ): 2122831392
Website: https://carpcup.app
E-mail: [email protected]
Phone: +421 948 20 88 99
registered in the Commercial Register of the District Court Trnava, Section: Sro, Insert No. 62928/T
(hereinafter referred to as the "Provider")

and a natural or legal person who, based on an accepted offer, enters into a contractual relationship with the Provider (hereinafter referred to as the "Client" or "Organizer").

The subject matter of the performance is the provision of access to a specialized online software system (web application) designed for the management, registration, and live evaluation of fishing competitions named CarpCup (hereinafter referred to as the "Software" or "Service").

The Service is provided exclusively in a "Turnkey Service" mode (Managed SaaS - Software as a Service). Under no circumstances does this constitute a sale of a license to the source code for download (on-premise). The Client's instance of the Service (the competition website) is operated exclusively on the Provider's infrastructure, specifically on a dedicated subdomain (e.g., name.carpcup.app). The main domain carpcup.app serves solely as the Provider's sales and presentation website. The target market is the European Union, whereas the System operates in multiple language versions.

Article II.
Contract Conclusion Process, Tax Conditions, and B2C Provisions

Conclusion of the Contract and Absence of an E-shop: The Service is not provided in the form of a standard self-service e-shop. The Contract on the provision of the Service is concluded exclusively on the basis of a direct inquiry from the Client, subsequent e-mail communication, and the acceptance of a price quotation. The valid conclusion of the Contract and the unconditional acceptance of these GTC (including the electronic Data Processing Agreement pursuant to Article X.) occurs at the moment 100% of the invoiced amount is credited to the Provider's bank account on the basis of an issued proforma invoice.

Delivery of Materials: Prior to the commencement of work by the Provider, the Client is obliged to deliver the complete requirements for the competition rules and a photograph (or a map) of the lake with marked fishing spots.

Advance Payment and User Acceptance Testing (UAT): The Client shall obtain access to the testing operation of the Service immediately after 100% of the amount is credited to the Provider's account (e.g., if paid one month in advance, the Client has one month for testing).

Minimum Time Limit and Waiver of Liability: In order to maintain sufficient time for testing and system debugging by the Client, the proforma invoice must be paid no later than one (1) week prior to the live start of the competition. If the Client pays the proforma invoice late and the competition website must go into live operation without an adequate testing period due to time constraints, the Provider bears absolutely no liability for any potential software errors (bugs) or outages.

Tax Requirements and B2B Sales in the EU: If the Client is a business entity with its registered office in another Member State of the European Union, the Client bears full legal and financial responsibility for providing a valid VAT ID prior to the issuance of the proforma invoice for the purpose of the correct application of the reverse charge mechanism (Reverse Charge).

Article III.
Pricing Packages, Advertising, and Intellectual Property

The Provider provides the Service in several pricing packages depending on the administration of advertising space on the Client's subdomain:
a) Package with Provider's Advertising (€149): The Provider reserves the exclusive and irrevocable right to place advertising banners of its partners into the Service (on the public competition website). A full 100% of the profit from this advertising space belongs to the Provider. If the Client accepts the presence of these advertisements, they shall receive a discount on the price of the Service, which is reflected in the package price.
b) Ad-Free Package (€199): A version of the Service without any advertising spaces.
c) Package with Organizer's Advertising (€249): A version of the Service with the option to insert the Client's (Organizer's) own advertising banners. With this option, the Provider is absolutely released from any and all liability regarding copyrights, trademarks, and the legislative legitimacy (including the prohibition of advertising for specific products) of the banners supplied by the Client. The Client bears sole and exclusive liability.

Intellectual Property and Maps: The Client expressly warrants that they own the copyrights to the supplied source photograph/map of the lake. Any graphic modifications, vectorizations, or interactive maps created by the Provider based on these materials shall become the exclusive intellectual property of the Provider (MIBO-SPRINGS s. r. o.) at the moment of their creation.

Prohibition of Reverse Engineering, Graphics Extraction, and Prohibition of Reselling: The Provider's custom source code (excluding open-source components under the GPL license), database architecture, PDF template design, and all visual and graphic elements of the user interface (including icons and libraries for which the Provider has duly purchased a commercial premium license, e.g., from the Flaticon database) are subject to strict copyright and license protection. The Client is strictly prohibited from engaging in reverse engineering, decompilation, or code extraction. Furthermore, the Client is strictly prohibited from extracting, downloading, copying, or commercially or non-commercially utilizing graphic elements (icons), map materials, and source files in any manner for their own use outside the closed environment of the CarpCup platform. Concurrently, there is an absolute prohibition on reselling access to other entities for the organization of their events.

Data Export: The Provider expressly excludes any obligation to provide Clients with raw database exports (SQL/CSV dumps). The Client exports all data (GDPR sheets, results, diplomas) on a self-service basis exclusively in the form of automatically generated PDF sheets using a module in the administration panel.

Article IV.
Technical Operation, Access Protection, and UGC (User Generated Content)

Prohibition of Core Access: The Service operates within a strictly closed ecosystem. The Client, the referees designated by them, or any third parties do not have, and under no circumstances shall gain, access to the deep administrator interface (WordPress admin), to the source code, or to the FTP/SFTP server. All core technical configurations and installations are performed exclusively by the Provider.

Limited Client Interface: The Client (unless ordering the GASTRO module) is granted access to only two password-protected subpages:
a) Referee Page: Contains exclusively a form for logging a catch (team selection, weight, mandatory photo upload).
b) Organizer Page (Admin): Allows for the management of team photos, contacts, running text (ticker), notifications (POP UP), manual addition of teams, random order for draws, fishing spot generator, management and transfer of teams, comprehensive catch management, issuance of cards and penalties, activation of an embargo (hidden finale), and protest management.

Password Sharing and UGC: The Client fully guarantees the security of the assigned access passwords. If the Client negligently or intentionally discloses the password to a third party and that party uploads illegal (e.g., pornographic, extremist) content to the Service, full legal, financial, and criminal liability shall be borne exclusively by the Client. The Provider is entitled to immediately and unilaterally change the password upon suspicion of a breach.

Article V.
Live Operation, "As-Is" Mode, and Limitation of Liability (Cap on Liability)

User Acceptance Testing (UAT): The Client has a strict obligation, from the time of payment of the proforma invoice until the start of the competition, to thoroughly click through the System and test all processes. During this period, the Provider provides support and rectifies any potential defects.

Live Start and "As-Is" Mode: As soon as the competition itself commences (live operation), the System runs exclusively in the "As-Is" mode. During the competition (especially during weekends), the Provider does not provide any telephone or immediate technical support.

Absolute Exclusion of Indirect Damages: The Provider bears no financial or legal liability for software errors (bugs), loss of connectivity, server crashes, or the Client's loss of profit. The Provider likewise bears absolutely no liability for the incorrect evaluation of results and the subsequent incorrect payout or non-payout of winnings and prizes to competitors by the Client.

Maximum Limitation of Damages (Cap on Liability): The Contracting Parties expressly agree that, to the maximum extent permitted by the legal order of the Slovak Republic, the maximum aggregate amount of any financial compensation for damages by the Provider to the Client shall under no circumstances exceed the amount actually paid by the Client for the software for that specific competition.

Indemnification: The Client undertakes that in the event any angler or third party brings a direct lawsuit or financial claim directly against the Provider (MIBO-SPRINGS s. r. o.) as a result of the operation of the competition, data management, or functioning of the Service, the Client shall fully financially and legally indemnify the Provider and reimburse all incurred costs of the proceedings.

Cyber Attacks and Force Majeure: The Provider bears no liability in the event of a targeted cyber (hacker, DDoS) attack on the Client's website, nor for damages caused by force majeure.

Third-Party Services and API Integrations (Maps and Weather): To enhance the user experience, the Software may utilize data and libraries provided by third parties via application programming interfaces (APIs), including but not limited to, weather forecasts (Open-Meteo API) or interactive maps (Leaflet.js). The Provider duly cites these services in the user interface in accordance with their licensing terms. The Provider expressly does not guarantee 100% availability (uptime) of these external services and bears absolutely no legal or financial liability for the accuracy of the provided data (e.g., for an incorrect weather forecast), nor for any damages, functionality limitations of the Software, or outages caused by the failure, delay, or change in the terms of these third-party services.

Article VI.
Hardware in the Field (BYOD) and Forensic Invalidity of Signatures (eIDAS)

Hardware and 4G Connectivity (BYOD): The Organizer fully guarantees the operability of their hardware (tablets, smartphones) and the availability and quality of their own (4G/5G) internet connection in the field. The Provider bears no liability in the event the application fails to save a fish due to a poor mobile signal, operator network outage, or a depleted battery.

eIDAS and Signatures: The physical signature of an angler captured by a finger or stylus on the Client's touch device does not possess the forensic validity of a qualified electronic signature within the meaning of Regulation (EU) No. 910/2014 (eIDAS). This signature serves exclusively for the operational needs of the Organizer, and the Provider expressly refuses to enter into any legal evidentiary proceedings regarding its authenticity or forgery.

Article VII.
Takedown Right (Immediate Shutdown), Zero-Day Vulnerabilities, and Exit Strategy

Takedown Right (Prohibitions): The Provider reserves the right to immediately, without prior notice, and without compensation for damages or refund of the price, delete and shut down the Client's website if it detects:
a) the operation of fake competitions (so-called Scam / entry fee fraud),
b) the operation of illegal betting and gambling through the Service,
c) expressions of hatred and hate speech (e.g., vulgar, racist team names),
d) the promotion of cruelty to fish and animals,
e) a massive spam-bot attack on the Client's form, which threatens the IP reputation of the Provider's SMTP servers.

Zero-Day Vulnerabilities: For data protection reasons, the Provider reserves the right to immediately shut down the Service in the event of the discovery of a critical security vulnerability in the core (so-called Zero-Day), until a security patch is deployed.

Exit Strategy: The Provider reserves the right to sell, assign, or transfer the CarpCup platform, including valid Contracts and Client databases, to another investor (third party) at any time in the future without their additional consent.

Article VIII.
Specific Provisions for the Premium GASTRO Module

In the event the Organizer pays an additional fee for the catering and buffet delivery management module in addition to the Service, the following strict limitations apply. This module operates as an e-commerce delivery system in the field (utilizing so-called "Magic Links" sent to a mobile phone at the fishing spot).

Nature of the Module: The System functions exclusively as a digital order pad and logistics dispatch. It does not contain a payment gateway. All payments are collected exclusively by the Organizer outside the System (cash, POS terminal, offline coupons).

Absolute Waiver of Liability: In these GTC, the Provider absolutely waives any and all liability for:
a) the health safety of the food, hygiene, sanctions from the Regional Public Health Authority (RÚVZ), failure to disclose allergens, and health consequences (e.g., food poisoning),
b) delivery logistics (late, lost, swapped, or undelivered orders to the fishing spot),
c) the loss of cash during collection by the Client's personnel,
d) any errors in revenue calculations that, as a result of technical errors (bugs) in the source code, would generate faulty PDF closing reports.

Not an e-Kasa (Taxes): The Organizer expressly declares that this Gastro module does not serve as a certified electronic cash register (e-Kasa). The obligation to issue valid tax documents and to tax revenues remains exclusively with the Organizer.

Obligation of Model Gastro-GTC for the Organizer: Since the angler orders food remotely via a mobile phone, they conclude an e-commerce contract directly with the Organizer, not with the Provider. The Client has a strict obligation to draft "Model Terms and Conditions for the Sale and Delivery of Food (Gastro GTC)", and the System will link them into the Magic Link (as a mandatory consent prior to ordering). These GTC must include a statutory exception regarding highly perishable goods (the impossibility of a 14-day right of withdrawal from the contract for the angler) and must absolutely and explicitly exclude any liability of the company MIBO-SPRINGS s. r. o.

Article IX.
GDPR, Data Processing Agreement, Archiving, and AI Training

Division of Roles under GDPR: The Client (Competition Organizer) acts exclusively in the capacity of the Data Controller. The Provider (MIBO-SPRINGS s. r. o.) acts exclusively as a technical Data Processor.

Electronic DPA: The Data Processing Agreement (DPA) concluded pursuant to the GDPR constitutes an inseparable electronic annex to these GTC. The DPA will not be signed in paper form; it is validly concluded and accepted exclusively electronically (via a checkbox upon ordering or by the payment of the proforma invoice).

Deletion of Photographs (From FTP) and Technological Backups: If an angler requests the Organizer to delete a photo of a catch, the Organizer shall hide/delete it in their interface (it will disappear from the public website). Important: The Organizer subsequently has a strict contractual obligation to contact the Provider without delay and provide the exact name/URL address of the given photo so that the Provider can manually and permanently delete it from the FTP server. Hosting and e-mails (SMTP) are operated by the sub-processor WebSupport, s.r.o. (data within the EU). The Client acknowledges the exception in the DPA that upon deletion of data from the FTP, such data will temporarily (for 14 to 30 days) remain in the encrypted automatic hosting backups for technological reasons, until they are overwritten.

Data Breach and Forms: Contact forms on the subdomains send data directly to the Client's e-mail. The Provider is not liable for their content. In the event a security incident (data breach from the server) is detected, the Provider has a contractual obligation to report it exclusively to the Organizer (within 48 hours). The obligation to report the breach to the anglers and authorities (Office for Personal Data Protection - ÚOOÚ) is borne by the Organizer.

Photo Theft (Scraping): The Provider bears no liability if a third party (marketing agency, e-shop) downloads a photograph of a catch from the public website and uses it illegally.

Data Archiving and Expiration: The Provider offers no "lifetime" guarantees for data storage on its servers.
a) Surcharge-Free Mode: Within 72 hours after the conclusion of the competition, the website and the data from it are irreversibly deleted.
b) Paid Archive: If the Client pays a surcharge for the archive, the data will remain publicly available for exactly one (1) year. Prior to the expiration of this year, the Provider will send an e-mail notification to the Client. If the Client fails to respond to the notification within 7 calendar days and does not pay the renewal fee, the Provider reserves the right to irreversibly delete the entire archive without any compensation.

Children and Double Opt-in: Given the participation of children under 16 years of age, the Organizer directly secures and bears responsibility for the consents of their legal guardians. The Organizer equally manages the granting of two consents from the angler (local GDPR and transfer of the fish to the "Carp Cup Cup" competition).

AI Training and Marketing Consents: In these GTC, the Client grants the Provider free consent for the B2B reference use of the Client's logo and consent to use strictly anonymized statistical data from the competitions for the training of the Provider's future Artificial Intelligence (AI) models.

Article X.
Cookies and the European Accessibility Act (EAA 2025)

Tracking Technologies: The Provider's Google Analytics tool and a proprietary URL Ad-Tracker for advertisements operate on the Client's subdomains. The Cookie banner implemented in the System must technically be maintained by the Organizer in a state that blocks these scripts until consent is granted by the visitors.

Accessibility for the Visually Impaired (EAA): The legal liability for ensuring that the generated public website (and the content added to it by the Client) complies with the rules of digital accessibility for the visually impaired within the meaning of the European Accessibility Act (EAA 2025) is borne fully by the Organizer (Client), not the Software Provider.

Article XI.
Special Provisions for Consumers (B2C) and ADR

Loss of the Right of Withdrawal (Digital Performance): If the Provider invoices a natural person (B2C non-entrepreneur), such person acknowledges that the delivery of the Service (generation of the subdomain and access credentials) constitutes the delivery of digital content that is not supplied on a tangible medium. By paying the proforma invoice and initiating the digital performance, the Consumer expressly agrees and acknowledges that at this moment they definitively lose the 14-day right of withdrawal from the Contract.

Alternative Dispute Resolution (ADR and ODR): The Consumer has the right to contact the Provider with a request for redress if they are not satisfied with the manner in which their complaint was handled. If the Provider rejects the request or fails to respond to it within 30 days, the Consumer has the right to submit a proposal for the initiation of Alternative Dispute Resolution (ADR) pursuant to Act No. 391/2015 Coll. The competent ADR entity is the Slovak Trade Inspection (www.soi.sk) or another authorized legal entity. The Consumer may use the European Online Dispute Resolution (ODR) platform to submit a proposal, available at: http://ec.europa.eu/consumers/odr/.

Article XII.
Final Provisions

Governing Law and Jurisdiction: These GTC, as well as the entire Contract and legal relations arising from it (including non-contractual ones), shall be governed exclusively by the legal order of the Slovak Republic, regardless of which EU country the Client originates from or in which of the 12 language versions the System is operating. The general courts of the Slovak Republic have exclusive jurisdiction to resolve any disputes.

Severability: The invalidity or ineffectiveness of any provision of these GTC shall not affect the validity and effectiveness of the remaining provisions. The invalid provision shall be replaced by one that most closely approximates the economic and legal intent of the original provision.

The Provider is entitled to unilaterally amend these GTC at any time. The amended GTC shall become effective on the date of their publication on the carpcup.app domain. For a specific Client, the version valid at the moment of payment of the proforma invoice for the Service is binding.

ANNEX NO. 1: DATA PROCESSING AGREEMENT (DPA)
AGREEMENT ON THE PROCESSING OF PERSONAL DATA (DPA)
(Data Processing Agreement pursuant to Article 28 of Regulation (EU) 2016/679 of the European Parliament and of the Council - GDPR)

This document constitutes an inseparable electronic annex to the General Terms and Conditions (hereinafter referred to as the "GTC") for the provision of the CarpCup software service.

(hereinafter referred to as the "Processor")

and

DATA CONTROLLER:
A natural or legal person (Competition Organizer) who, based on the acceptance of the GTC and payment of the proforma invoice, has ordered the CarpCup software service.
(hereinafter referred to as the "Controller")

(The Processor and the Controller collectively hereinafter also referred to as the "Contracting Parties")

The Contracting Parties expressly agree that this Agreement on the Processing of Personal Data (hereinafter referred to as the "Agreement" or "DPA") is not concluded in paper (hardcopy) form. Its valid and effective conclusion occurs exclusively electronically, namely at the moment of unconditional acceptance of the GTC or by the actual crediting of the payment of the proforma invoice for the Service to the Processor's bank account.

Article II.
Subject Matter, Purpose, and Division of Roles

Division of Roles under GDPR: The Controller (Organizer) is in the exclusive position of a Data Controller in relation to the personal data of anglers and event participants, as they independently determine the purposes and means of processing and enter the requirements and subject data into the System. The company MIBO-SPRINGS s. r. o. acts exclusively in the limited capacity of a technical Data Processor, providing computing infrastructure, storage, and software as a service (SaaS) for the Controller.

Subject Matter of the Agreement: Regulation of mutual rights and obligations during the processing of personal data, which the Processor processes on behalf of the Controller on a dedicated subdomain.

Purpose of Processing: Provision of a digital platform for the management, registration, archiving, and live evaluation of fishing competitions, generation of PDF sheets, and online publication of results strictly in accordance with the Controller's instructions.

Categories of Data Subjects and Data: Personal data of competitors (including children under 16 years of age represented by an attending legal guardian), team members, and referees are processed. The scope includes identification data (name, surname, initial, team name), contact data (if entered into the System), and visual appearance (photographs of catches capturing a likeness).

Article III.
Rights and Obligations of the Controller

The Controller declares and bears full legal and financial responsibility that they have acquired the personal data legally and possess a valid legal basis (especially consent) for its processing, storage, and publication. In the case of persons under 16 years of age, the Controller is responsible for demonstrably obtaining the consent of a parent (legal guardian).

The Controller is exclusively responsible for fulfilling the information obligation towards the data subjects and for handling their requests to exercise rights (erasure, rectification, access to data). If a request is submitted directly to the Processor, the Processor shall forward it to the Controller for handling.

Flows from Forms: The Contracting Parties expressly state that contact forms on the Client's subdomain (the public competition website) transmit their content via SMTP (e-mail) directly and exclusively to the e-mail address of the Controller. The Processor does not store this data in a database and is not liable for data that has left the web System and been delivered to the Client's e-mail.

Article IV.
Rights and Obligations of the Processor and Sub-processors

The Processor processes personal data exclusively on the basis of documented instructions from the Controller, which in this context are deemed to be the legitimate actions themselves performed by the Controller, their referees, and authorized persons in the Client and administrator interfaces of the System.

The Processor ensures that persons authorized by it to process data are bound by a strict contractual or statutory obligation of confidentiality.

Sub-processors: By granting consent to the GTC and the Agreement, the Controller hereby grants the Processor general authorization to engage further processors. The Contracting Parties expressly acknowledge that the main sub-processor providing server hosting, databases, FTP storage, and e-mail infrastructure (SMTP) is the company WebSupport, s.r.o. (Company Identification Number: 36 421 928, with its registered office at Karadžičova 12, 821 08 Bratislava). All production data and backups are physically stored on servers within the European Union.

Article V.
Special Procedure for Deletion from FTP (Right to be Forgotten) and Exception for Backups

Given the closed and secured architecture of the System (in which the Controller does not have direct FTP/SFTP access to the server), the Contracting Parties have agreed on a strict and sole possible procedure for the deletion of photographs:
a) Step 1 (Hiding on the front-end): Upon exercising the right to erasure, the Controller is obliged to immediately hide or delete the specific photograph in the Client interface of the System, thereby promptly preventing its publication on the competition website.
b) Step 2 (Notification Obligation of the Controller): Since hiding does not remove the source file from the server (to prevent database errors), the Controller has a strict contractual obligation to immediately send an e-mail to the Processor requesting permanent deletion, precisely specifying the file name or its direct URL address.
c) Step 3 (Physical Deletion): The Processor shall subsequently (upon receipt of the targeted notification) perform a manual, permanent deletion of the file directly from the FTP server. The Processor bears no legal liability for a photograph remaining physically accessible via a direct link (hotlink) if the Controller neglected to fulfill Step 2.

TECHNOLOGICAL EXCEPTION FOR BACKUPS: The Controller is fully informed and unconditionally agrees that, for critical security reasons (Disaster Recovery and business continuity), automatic encrypted hosting backups are comprehensively performed by the Sub-processor. The Contracting Parties expressly agree that even after the active and definitive deletion of data (including photographs and post-competition records) from the live database or active FTP server, such data will temporarily remain stored in passive system hosting backups for technological reasons for a period of 14 to 30 calendar days, until they are automatically overwritten and permanently destroyed by the retention cycle. During this period, the data is offline and is not processed for other purposes. This transitional technological existence of data in backups is not considered a breach of the GDPR, the DPA, nor the right to erasure and the right to be forgotten.

Article VI.
Personal Data Breach (Data Breach) and Notification Obligation

Notification Exclusively to the Organizer: If the Processor discovers a personal data breach (e.g., a database leak or cyber attack) on its infrastructure, it undertakes to report this fact exclusively to the Controller, without undue delay, but no later than 48 hours from the moment of reliable detection of the security incident.

Exclusive Responsibility of the Controller Towards Authorities: The Contracting Parties expressly agree that the Processor has no statutory, contractual, or delegated obligation to report a security incident to the Office for Personal Data Protection of the Slovak Republic, nor to report it directly to the data subjects (anglers). The entire reporting and bureaucratic obligation under the GDPR is borne exclusively by the Controller as the data controller, at their own expense and on their own responsibility.

Article VII.
Termination of the Agreement, Archiving, and Data Destruction

This Agreement is concluded for a definite period, identical to the duration of the provision of the Service in accordance with the GTC.

The Processor does not provide database dumps (raw SQL/CSV exports) to the Controller. The Controller backs up the results in the form of self-service generation of PDF sheets via the interface.

Surcharge-Free Mode (Destruction within 72h): Provided the Controller has not paid for the paid archive service, the Processor shall, upon the expiration of 72 hours from the official end of the competition, cancel the entire subdomain and actively and irreversibly delete all data (databases, FTP files).

Paid Archive: If the paid archive was paid for, the data on the public website will remain available for exactly one (1) year. Prior to the expiration of this period, the Processor will send a notification to the Controller's e-mail. If the Controller fails to pay the fee within 7 calendar days, all data will be irreversibly destroyed by the Processor.

The Exception for Backups defined in Article V. paragraph 2 applies in full and shall also be applied after the final comprehensive destruction of data pursuant to this Article.

Article VIII.
Final Provisions

Matters not regulated by this Agreement shall be governed by the Processor's GTC and the applicable legal regulations of the Slovak Republic. In the event of a conflict between this Agreement and the GTC, the provisions of this Agreement shall prevail regarding matters of technical processing of personal data.
